A Framework That Changed in 2025
Indonesia’s royalty framework sits on Law No. 28 of 2014 on Copyright and Government Regulation No. 56 of 2021. In August 2025, Minister of Law Regulation No. 27 of 2025 replaced the earlier implementing regulation, strengthening LMKN’s role as the central collection body and setting out in detail which commercial uses attract royalties.
For operators, the practical effect is that the obligation is now explicit and the categories are named. Ambiguity about whether a hotel lobby or a café playlist counts as commercial use has largely gone.
Permenkum 27/2025 places the royalty obligation on the event organiser or the business owner — not the performer, and not the supplier. The establishment operating the premises is the responsible party, and that responsibility does not transfer through a subscription agreement.
The Five Rights
Commercial music is not one permission. It is five:
- 1. Public performance of the composition — the melody and lyrics as written
- 2. Public performance of the sound recording — the specific recorded track
- 3. Reproduction of the sound recording — any copy held on playback hardware
- 4. Recording and master rights — held by labels and recording owners
- 5. Publishing rights for commercial use — held by music publishers
Collective management through LMKN and its member LMK addresses public performance. The remaining rights sit with labels, distributors and publishers, and require separate clearance.

Who is responsible for paying royalties — the venue or the performer?+
The event organiser or business owner. Permenkum 27/2025 states this directly, and it was reinforced by the Supreme Court in the Agnez Mo and Ari Bias dispute.
